Fasting the Six Days of Shawwāl before making Qadā of the days missed in Ramadān

Question: Is it legislated to fast the six days of Shawwāl before making Qadā of the missed days for the one who has days from Ramadhan to make up? Some people allow it saying that A’ishah (radiyallāhu ‘anhā) did not make up the days she missed of Ramadhan until Sha’bān, in the month before the next Ramadān ― so what is apparent is that she fasted the six days of Shawwāl [before making up the days she missed] due to what is known of her desire to do good deeds.

Answer: In the name of Allaah, Most Merciful, The Bestower of Mercy. May Allaah extol and praise the Messenger in the highest company of Angels ―and likewise, his family, his Companions and whoever is guided by his guidance.

What is apparent in this affair is that it is not allowed to fast the Sunnah (nafal) fasts before the obligatory fasts due to two reasons:

Wahb bin Munabbih رحمه الله stated:

“Memorize three things from me:

●Beware of (evil) desires that are followed.

●Beware of (having) an evil companion.

●Beware of (being) a person who is amazed with himself.”

The mindset, preparation and practices of The Salaf during Ramadan

Our Shaykh Abu Bilaal Al-Hadhramy- may Allah preserve him- was asked the following question on 30th Sha'baan 1441 ( 23rd April 2020):

Question: How did The Salaf prepare for the month of Ramadan?

Answer: First of all, they would be overjoyed by its arrival and rejoice at it. 

(1. Supplication)

They would spend six months asking Allah (سُبْحَانَهُ وَ تَعَالى) to allow them to reach Ramadan and if they fasted Ramadan; they would spend (the next) six months asking Allah to accept it from them.

It has indeed been reported that Yahya ibn Abee Kathir (may Allah have mercy upon him) used to say: 

"اللهم سلِّمنا لرمضان وسلِّم رمضان لنا"

"Oh Allah; deliver us to Ramadan and deliver Ramadan to us."

It is a month of sweet scented blessings, a month of forgiveness of sins and a month of goodness - all of it.

(2. Recitation of The Qur’ān)

So there is no doubt that it is a bringer of joy and the Salaf were certainly overjoyed with it. From their over enjoyment, they would recite the book of Allaah more in it than outside of it. 

In fact; it was mentioned regarding Sufyān At-Thawree  (may Allah have mercy upon him - that when Ramadan entered he would leave all actions and devote his (complete) attention to The Qur’ān.

Similarly, it was also reported that Imam Malik - may Allah have mercy upon him) despite his deep love for narrating hadith and hadith in general; once Ramadan had entered he devoted his (complete) attention to The Qur’ān and stopped narrating hadith, this was his preparation. 

(3. Sitting in the Masjid)

Our Shaykh, the 'Allāmah, the Trustworthy Advisor, Abū 'Abdirrahmān Yahya bin 'Alī Al-Hajūri - may Allāh preserve him - mentioned on the 28th Rajab 1442:

"The funeral prayer does not compensate for Tahiyyatul Masjid (1) due to there being no rukoo' in it and the hadeeth states:

"Until he performs rak'atain (two rukoo')"

And likewise witr by itself (one rak'ah) does not compensate for it either because in the hadeeth:

"Until he performs rak'atain"

Do forgiven sins remain recorded in the scrolls?

Answered by our Shaykh, the 'Allāmah, the Trustworthy Advisor, Abu 'Abdirrahmān Yahya bin 'Ali Al-Hajūri - may Allāh preserve him - on the 9th, Sha'bān, 1442H

Question: The one who is forgiven, are his sins erased from his scrolls?

Answer: Yes, they are erased, if Allāh forgives him, he erases them for him.

(يَمْحُوا۟ ٱللَّهُ مَا يَشَآءُ وَيُثْبِتُۖ وَعِندَهُۥٓ أُمُّ ٱلْكِتَٰبِ)

"Allāh blots out what He wills and confirms (what He wills). And with Him is the Mother of the Book (Al-Lawh Al-Mahfūdh)"

[Ar-Ra'd, 39]

(فَأُو۟لَٰٓئِكَ يُبَدِّلُ ٱللَّهُ سَيِّـَٔاتِهِمْ حَسَنَٰتٍۗ وَكَانَ ٱللَّهُ غَفُورًا رَّحِيمًا)

"For those, Allāh will change their sins into good deeds, and Allah is Oft-Forgiving, Most Merciful."

[Al-Furqān, 70]

So they are erased. His statement 'forgive', it (means)  covering and erasing and removing.

(قُلْ يَٰعِبَادِىَ ٱلَّذِينَ أَسْرَفُوا۟ عَلَىٰٓ أَنفُسِهِمْ لَا تَقْنَطُوا۟ مِن رَّحْمَةِ ٱللَّهِۚ إِنَّ ٱللَّهَ يَغْفِرُ ٱلذُّنُوبَ جَمِيعًاۚ إِنَّهُۥ هُوَ ٱلْغَفُورُ ٱلرَّحِيم)ُ 

"Say: "O 'Ibādi (My slaves) who have transgressed against themselves (by committing evil deeds and sins)! Despair not of the Mercy of Allāh, verily Allāh forgives all sins. Truly, He is Oft-Forgiving, Most Merciful."

[Az-Zumar, 53]

And the black thawb is more concealing of stains, so it includes covering and erasing.

Does guardianship go to the ruler straight away if the father prevents marriage?

Answered by our Shaykh, the 'Allāmah, the Trustworthy Advisor, Abu 'Abdirrahmān Yahya bin 'Ali Al-Hajūri - may Allāh preserve him - on the 16th, Muharram, 1442H

Question: If the father prevents (his daughter) from marrying, does the guardianship transfer to the wali next in line or to the judge straight away?

Answer: In the Hadith, 

فَالسُّلْطَانُ وَلِيُّ مَنْ لاَ وَلِيَّ لَهُ

"Then the ruler/judge is the wali (guardian) of the one who has no wali (guardian)."

So if it is possible for the brother for example to take the place of the father and take guardianship of her, then verily she has guardians other than the father, it enters into the (Hadith) one who has no wali and he is a wali to her and he is the brother.
